These Terms and Conditions govern the use of the ecaterra.com site and the services provided by Ecaterra Capital Inmobiliario S.A.S. By accessing the site or signing up as a user, you accept this document in full.
1. Purpose
Ecaterra operates a collaborative-financing technology platform (crowdlending) that allows individuals to lend capital to vetted real-estate developers, secured by a mortgage or a commercial trust. Ecaterra is not part of the Ecuadorian financial system and does not take public deposits.
2. Capacity and registration
To register you must be an individual aged 18 or over, with a valid national ID or passport and a bank account at an Ecuadorian financial institution. You agree to provide accurate information and keep it up to date.
3. Nature of the relationship
By investing, you sign a civil loan contract with the real-estate developer. Ecaterra acts only as a technological intermediary and trust administrator. It does not guarantee yield or repayment.
4. Risk of loss
The user acknowledges that real estate crowdlending involves risk of default, construction delays, collateral enforcement and full or partial loss of invested capital. Past performance does not assure future returns.
5. Fees
Ecaterra charges the developer an origination fee at disbursement, and the lender an annual fee on interest earned. The fee schedule in force is published on each project card.
6. Regulatory compliance
We comply with Ecuadorian regulation on anti-money-laundering, counter-financing of terrorism and personal data protection (UAFE, LOPDP), and we report to the authorities where applicable.
7. Intellectual property
The Ecaterra brand, the ecaterra.com domain, the site design and all published content are owned by Ecaterra Capital Inmobiliario S.A.S. Reproduction without express authorization is prohibited.
8. Limitation of liability
Ecaterra is not liable for internet outages, force majeure, developer decisions or downturns in the real-estate market. Its liability is limited to the obligations expressly assumed in these Terms.
9. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Ecuador. Any dispute shall be submitted to the competent courts of the city of Quito, Metropolitan District, the parties waiving any other jurisdiction.
